What do we do?

We respect your rights and strive to fulfill your requests within the deadlines set by law. We handle your data the way we expect others to handle ours.

The protection of your personal data is a top priority for us. We take care of your data, move it over encrypted channels, and never sell it to anyone, never use it for any purpose other than the one you provided it for.

We have a website, we measure its usage, we keep logs for security reasons, we run online marketing with targeted campaigns, and we process the data you provide.

If you ask, after identification we will hand over your data. If you ask, we will delete your data.

Our services

• Website
  We log visits to our website for security reasons (IP address, pages viewed). With Google Analytics we track what you view so we can produce more content that interests you (cookies). Facebook and Google AdWords cookies are placed in your browser; you may later see Hobby Garden Kft. advertisements through these providers. We delete this data after 90 days.
• Newsletter
  By providing your email address and name you can subscribe to our newsletter. We inform you by email about new promotions and news. Every email includes an unsubscribe link so you can opt out at any time if you change your mind. We store your data for 365 days after the last interaction.
• Subscription
  If you subscribe to our service, we keep your contact details and our notes in our CRM system for 3 years from our last contact.
  Due to legal requirements, part of your personal data and the data on issued invoices is retained for the period required by applicable law (at least 10 years, at most 15 years from the issuance of the last invoice).

Detailed Privacy Policy

In drafting the provisions of this notice (hereinafter: Notice), the company paid particular attention to Regulation 2016/679 of the European Parliament and of the Council (the “General Data Protection Regulation” or “GDPR”), Act CXII of 2011 on informational self-determination and freedom of information (“Infotv.”), and Act V of 2013 on the Civil Code (“Ptk.”).

Data Processing takes place on the basis of the voluntary, prior, properly informed declaration of the natural persons representing the Users, which declaration contains the Users' express consent to the use of the Personal Data they provide while using the service and the Personal Data generated about them. In the case of consent-based data processing, Users are entitled to withdraw their consent at any time, which, however, does not affect the lawfulness of the processing carried out before the withdrawal.

By providing their data, every User assumes responsibility that they use the service exclusively as a User from the email address provided and with the data provided. In view of this assumption of responsibility, all liability connected with logins using a given email address and/or data rests exclusively with the User who registered the email address and provided the data.

The User warrants that they have lawfully obtained the consent of the natural person concerned for the processing of any personal data they provide or make accessible about other natural persons while using the services.

The legal basis for Data Processing within or in connection with the Service may be, in addition to the User's voluntary consent, the Data Controller's substantial legitimate interest, as well as ensuring the fundamental rights to information and freedom of expression, within the limits defined by law.

Declaration of consent to the processing of my personal data

I give my voluntary and express consent to the processing of the data I provide when visiting, subscribing, or registering on the electronic platforms of Hobby Garden Kft. (www.hobbygarden.hu, Facebook, Instagram, advertisements, Google Ads advertisements).

Simultaneously with recording my data, I declare that I am a person over 18 years of age with legal capacity. Where I represent a legal person or an organization without legal personality, I am a person authorized and entitled to represent that person or organization and to grant the consent required for the data processing described in this Notice.

I declare that I will not provide any special categories of personal data to Hobby Garden Kft. in any form, either during registration or later. Special categories of personal data include, among others: racial or ethnic origin; political opinions; religious or philosophical beliefs; trade union membership; genetic or biometric data suitable for identifying a person; health data, or data concerning sex life or sexual orientation.

I declare that I will not provide Hobby Garden Kft. with any personal identification numbers – non-exhaustive examples: passport number, personal ID number, identity card number, address card number, driving license number.

With my consent I acknowledge that Hobby Garden Kft. may send me letters with advertising content related to its field of activity, information materials, event invitations, and may contact me by phone.

I may withdraw my consent to the processing of my data at any time, in the ways described in the Notice, for example by a request sent to segitunk@hobbygarden.hu.

Legal basis founded on legitimate business interest

If you provide your data by filling in a form and indicate your interest in Hobby Garden Kft., we treat your application as preparation for a contract. In this case, the legal basis of the processing of your Personal Data under the GDPR becomes a legal basis founded on legitimate business interest. This changed legal basis does not alter your rights or the processing of your Personal Data; the only difference is that during the preparation of the contract, unless you request termination of the process, we continue to process your Personal Data in the interest of and for the purpose of preparing the contract.

Legal basis founded on contract

If you use the services of Hobby Garden Kft., you do so under the conditions detailed in the General Terms and Conditions. In this case, the legal basis of the processing of your Personal Data under the GDPR becomes a contractual legal basis. This changed legal basis does not alter your rights or the processing of your Personal Data; the only difference is that during the term of the contract, even if you withdraw the consent you gave before the contract existed, we continue to process your Personal Data in the interest of and for the purpose of performing the contract.

Once the contract is performed or terminated, the legal basis of your data processing changes again and we continue to process your Personal Data on the basis of legislation.

After termination or performance of the contract, on the basis of legislation

With regard to the data appearing on invoices, we are obliged by law to continue processing your Personal Data.

Your rights

You have the following rights. Under the GDPR we must respond to your request within a maximum of 1 month. We do everything we can to react much sooner.

Right to information

You may request information about the personal data we process about you. You may request access to this data.

You may request information at any time in writing by registered letter with return receipt sent to our address, or by email sent to segitunk@hobbygarden.hu. We consider a request for information sent by letter authentic if we can clearly identify you based on the request sent.

We consider a request for information sent by email authentic only if you send it from your registered email address; this does not, however, exclude that for security reasons we may identify you by other means before providing the information.

The request for information may cover the data we process, its source, the purpose and legal basis of the processing, its duration, the names and addresses of any data processors, activities related to the data processing, and – in the case of transfers of Personal Data – who received or receives your data and for what purpose.

Right of access

If you ask us to inform you whether the processing of your Personal Data is in progress, then in the case of a yes answer you may receive access to the purpose of the processing, the categories of data, the recipients, the duration of data storage, data subject rights, remedies, the source of the data, automated decision-making, and transfers abroad.

Right to rectification

You may at any time request the rectification or modification of your Personal Data in writing by registered letter with return receipt sent to our address, or by email sent to segitunk@hobbygarden.hu. Taking into account the purpose of the processing, you may request the completion of incomplete Personal Data.

Right to be forgotten (Right to erasure)

You may request the deletion of the Personal Data we process. The deletion may be refused (i) for the exercise of the right to freedom of expression and information, or (ii) if the processing of the Personal Data takes place in the public interest (authorized by law); and (iii) for a justifiable private interest (for the establishment, exercise, or defense of legal claims).

We will always inform you of the refusal of a deletion request, indicating the reason for refusing the deletion. After fulfilling a request for the deletion of Personal Data, the previous (deleted) data can no longer be restored.

Newsletters can be canceled via the unsubscribe link found in them.

Right to restriction of processing

You may request that we restrict the processing of your Personal Data if you contest the accuracy of the processed Personal Data. In this case, the restriction applies to the period that allows us to verify the accuracy of the Personal Data.

We will mark the Personal Data we process if you contest its correctness or accuracy, but the incorrectness or inaccuracy of the contested Personal Data cannot be clearly established.

You may request that we restrict the processing of your Personal Data also if the Processing is unlawful, but you oppose the deletion of the processed Personal Data and instead request the restriction of their use.

You may also exercise this right if the purpose of the Processing has been achieved, but you require the processing of your data for the establishment, exercise, or defense of legal claims.

If you object to the data processing, we will restrict the processing of your Personal Data, and the restriction applies to the period until it is established whether the data controller's legitimate reasons take precedence over the data subject's legitimate reasons.

Right to data portability

You may request that the Personal Data you provided to us and processed by automated means be handed over to you in a structured, widely used, machine-readable format provided by Hobby Garden Kft. software (XML/XLS/CSV) and/or transferred to another data controller.

Right to object

You may object to the processing of your Personal Data (i) if the processing of the Personal Data is necessary solely for the fulfillment of a legal obligation applicable to us or for the enforcement of our legitimate interests; (ii) if the purpose of the Processing is direct marketing, opinion polling, or scientific research; or (iii) if the Processing takes place for the performance of a task in the public interest.

We will examine the lawfulness of the objection, and if we establish that the objection is well-founded, we will terminate the Processing and block the processed Personal Data, and we will notify of the objection and the measures taken on its basis all those to whom the Personal Data concerned by the objection were previously transferred.

Based on the profile data, we target and build newsletters using manually created filters. There is no decision made by automated data processing in the process.

Web analytics on the website

We inform you that to measure the traffic of the www.hobbygarden.hu website, to monitor the behavior of its visitors, to prepare statistics, and to measure the effectiveness of its advertisements, we use the Google Analytics, Google Remarketing, Google Ads Conversion Tracking, and Facebook Remarketing programs.

The referenced programs place so-called cookies in your browser, which store unique user identifiers. As a visitor to the hobbygarden.hu website, you allow the use of the Google Analytics, Google Remarketing, Google Ads Conversion Tracking, and Facebook Remarketing programs. At the same time, you consent to the monitoring and tracking of your behavior and to the use of all services provided by the programs.

In addition, you have the option at any time to disable the data recording and data storage of cookies for the future, as described below. We inform you that the settings and use of the Google Analytics, Google Remarketing, Google Ads Conversion Tracking, and Facebook Remarketing programs fully comply with the requirements of the data protection authority.

According to Google, Google Analytics mainly uses first-party cookies to report visitor interactions on your website. These cookies only record information that is not suitable for personal identification. Browsers do not share their own cookies between domains. Google Analytics

Hobby Garden Kft. uses the Google Analytics program primarily to produce its statistics, including measuring the effectiveness of its campaigns. Through the program, Hobby Garden Kft. mainly obtains information about how many visitors visited its Website and how much time visitors spent on the Website. The program recognizes the visitor's IP address, so it can track whether the visitor is a returning or new visitor, and it can track the path the visitor took on the Website and where they entered.

Google Remarketing

By using the Google Remarketing program, Hobby Garden Kft. collects DoubleClick cookie data in addition to the usual Google Analytics data. The DoubleClick cookie enables the use of the remarketing service, which primarily ensures that visitors to the Hobby Garden Kft. Website later encounter Hobby Garden Kft. advertisements on available Google advertising spaces. Hobby Garden Kft. uses the Google Remarketing program for its online advertisements. Hobby Garden Kft.'s advertisements are also displayed on internet websites by third-party providers – such as Google. Hobby Garden Kft. and third-party providers, such as Google, jointly use their own cookies (such as Google Analytics cookies) and third-party cookies (such as the DoubleClick cookie) to inform themselves based on users' previous visits to the Website, and to optimize and display advertisements.

Google Ads conversion tracking

The purpose of Google AdWords conversion tracking is to enable Hobby Garden Kft. to measure the effectiveness of Google Ads advertisements. It does this using cookies placed on the user's computer, which exist for 30 days.

Facebook Remarketing

Hobby Garden Kft. uses the Facebook remarketing pixel to increase the effectiveness of Facebook advertisements, for the purpose of building a so-called remarketing list. Thus, after visiting the Website, a third-party provider – such as Facebook – may display advertisements on internet websites. Remarketing lists are not suitable for personal identification. They do not contain the visitor's personal data; they only identify the browser software.

Disabling cookies

If you want to manage your cookie settings or disable the function, you can do so in your own browser. Depending on the browser's toolbar, this option can be found in the cookies/tracking functions menu. Generally, under Tools > Settings > Privacy you can set which tracking functions you enable/disable on your computer.

If you do not want Google Analytics to report on your visits, you can install the Google Analytics opt-out browser add-on. This add-on instructs the Google Analytics JavaScript scripts not to send visit information to Google. If you have installed the opt-out browser add-on, you will not participate in content experiments either.

Principles of data processing

• The Data Controller processes Personal Data in accordance with the principles of good faith, fairness, and transparency, as well as the applicable legislation and the provisions of this Notice.
• The Data Controller uses the Personal Data strictly necessary for using the Services on the basis of the consent of the User concerned, and exclusively in a purpose-bound manner.
• The Data Controller processes Personal Data only for the purposes specified in this Notice and in the applicable legislation. The scope of the processed Personal Data is proportionate to the purpose of the processing and may not go beyond it (data minimization).
• Hobby Garden Kft. as a service provider does not process the Personal Data of persons under 18 years of age.
• The Data Controller does not transfer the Personal Data it processes to third parties other than the Data Processors specified in this Notice and, in certain cases referenced in this Notice, the External Service Providers. An exception to this provision is the use of data in statistically aggregated form, which may not contain in any form any other data suitable for identifying the User concerned, and thus does not qualify as Data Processing or data transfer.
• In certain cases – official court or police inquiries, legal proceedings due to copyright, property, or other infringements or their well-founded suspicion, harm to the Data Controller's interests, endangerment of the provision of the Services, etc. – the Data Controller makes the available Personal Data of the User concerned accessible to third parties.
• The Data Controller's system may collect data about Users' activity that cannot be linked to other data provided by the User at registration, nor to data generated when using other websites or services.
• The Data Controller notifies the User concerned, as well as all those to whom the Personal Data was previously transferred for Data Processing purposes, of the rectification, restriction, or deletion of the Personal Data it processes. The notification may be omitted if, considering the purpose of the Data Processing, it does not harm the data subject's legitimate interest.
• The Data Controller ensures the security of Personal Data, takes the technical and organizational measures, and establishes the procedural rules that ensure that the recorded, stored, and processed data is protected, and prevents its accidental loss, unlawful destruction, unauthorized access, unauthorized use, unauthorized alteration, and unauthorized distribution. The Data Controller calls on every third party to whom it transfers Personal Data to fulfill this obligation.
• In view of the relevant provisions of the GDPR, the Data Controller is not obliged to appoint a data protection officer.
• The Data Controller is responsible for compliance with these principles.

Confidential data handling

Hobby Garden Kft. treats the recorded data confidentially and does everything for the security of the data, using it in the manner necessary for the proper functioning of the Website. This includes, among other things, sending emails and SMS messages to you and to the contact details you provided, in which case the message is sent through the given service provider.

Hobby Garden Kft. will never sell or lend your personal data to third parties for marketing purposes. In response to a subpoena, court order, or within the framework of legal proceedings, Hobby Garden Kft. may, if necessary, hand over your personal data and other relevant information.

Furthermore, Hobby Garden Kft. may assert or exercise its statutory rights and defend itself against court claims.

In the interest of secure data handling, Hobby Garden Kft. selects the IT tools used in processing the data in such a way that during operation the processed data is accessible exclusively to Hobby Garden Kft. – as the party authorized to do so –, its authenticity is preserved, no change occurs in the recorded data – apart from the data recording procedure –, and the recorded data is protected from unauthorized access.

The data processed by Hobby Garden Kft. may be transferred upon official or court request, as well as on the basis of legal requirements, of which fact Hobby Garden Kft. notifies its users in its newsletter, provided that this is not contrary to the official or court request or the relevant legal requirement.

Our employees' access to personal data

We provide our employees only with the access to the personal data we process that is strictly necessary for their work. We log every access, and we provide only highly restricted access to the data export function.

Duration of data processing

In accordance with the requirements of the GDPR, we process your data with a predefined retention limit for each category of processed data.

As a rule of thumb, detailed security logs are stored for 90 days, other security logs for 365 days.

Personal data is stored for 365 days after the last contact, except where legal requirements or the performance of a contract requires a longer period.

Data transfer

We are entitled and obliged to transfer to the competent authorities any Personal Data at our disposal and lawfully stored by us whose transfer is required of us by law or by a final and binding official order. The Data Controllers cannot be held liable for such data transfers and their consequences.

If we hand over the operation or utilization of our service in part or in whole to a third party, we may hand over the Personal Data we process, in part or in whole, to this third party without requesting your separate consent, but with appropriate prior notification to you, provided that this data transfer may not put you in a position more disadvantageous than the data processing rules indicated in the version of this Notice in force at the time. In the case of a data transfer under this paragraph, we provide you with the opportunity to object to the data transfer before it takes place. In the case of an objection, the transfer of your data under this point is not possible.

For the purpose of verifying the lawfulness of the data transfer and informing the data subject, the data controller keeps a data transfer register, which contains the time of the transfer of the personal data it processes, the legal basis and recipient of the data transfer, the definition of the scope of the transferred personal data, and other data specified in the legislation prescribing the data processing.

Updating the Notice, following legislative changes

The data controller continuously reviews and updates the Notice in accordance with changes in the legislative environment and the expectations of the authorities. You can stay informed about the current Notice under the “Privacy Policy” section of the Hobby Garden Kft. website.

In the event of a violation of your rights, you may turn to court. The adjudication of the case falls within the competence of the regional court. The case may – at your choice – also be brought before the regional court of your place of residence or stay. Upon your request, we will inform you of the possibilities and means of legal remedy.

Definitions

• Data Processing: regardless of the procedure used, any operation or set of operations performed on Personal Data, in particular the collection, recording, organization, structuring, storage, adaptation, alteration, use, retrieval, consultation, use, disclosure, transmission, dissemination or otherwise making available, publication, alignment or combination, restriction, erasure, and destruction of Personal Data.
• Personal Data or data: any data or information on the basis of which a natural person becomes – directly or indirectly – identifiable, or such a person enters data into the System.
• Data Processor: the service provider that processes Personal Data on behalf of the data controller. In the case of the System services referenced in this Notice, the data processor is Hobby Garden Kft. and the sub-processors are the sub-processors indicated in the Notice.
• GDPR: Regulation 2016/679 of the European Parliament and of the Council (the “General Data Protection Regulation”).
